CONTRACTUAL DOCUMENTS
By registering an Order on the Site or by sending an Order by telephone, email or fax, the Buyer agrees to the form of communication - telephone, online or e-mail - through which the Seller carries out its commercial operations.
The notification received by the Buyer after placing the Order has the role of information and does not represent the acceptance of the order. This notification is made either electronically, via an email sent automatically by the site, or by telephone. The Seller reserves the right to change the quantity of goods and / or services in the Order, for justified reasons. In this case, it will notify the Buyer at the e-mail address or telephone number provided to the Seller when placing the Order and will return the amount paid.
The invoice is a simplified sale-purchase contract according to the legislation in force.
The sale-purchase contract is considered concluded between the Seller and the Buyer at the moment when the Seller issues the notification of dispatch of the order. These terms and definitions form an integral part of the sale-purchase agreement between the parties.
ONLINE SALES POLICY
Access to place an Order is permitted to any Customer / Buyer.
For justified reasons, S.C. ELIXIR MANUFACTURTA S.R.L. reserves the right to restrict the access of the Customer / Buyer in order to place an Order and / or to some of the accepted payment methods, if it considers that, based on the conduct or activity of the Customer / Buyer on the Site, its actions could harm somehow SC ELIXIR MANUFACTURA S.R.L. In any of these cases, the Customer / Buyer may contact the Customer Relations Department of S.C. ELIXIR MANUFACTURA S.R.L., to be informed of the reasons that led to the application of the above measures. Communication with the Seller can be done through direct interaction with him or through the addresses mentioned in the "contact" section of the Site. The seller is free to manage the information received without having to provide justifications.
In the case of an unusually high volume of traffic coming from an internet network, S.C. ELIXIR MANUFACTURA S.R.L. reserves the right to ask Customers / Buyers to manually enter the captcha validation codes, in order to protect the information within the Site.
SC ELIXIR MANUFACTURA S.R.L. may publish on the Site information about Goods and / or Services and / or promotions practiced by it or by a third party with which S.C. ELIXIR MANUFACTURA S.R.L. has concluded partnership contracts, in a certain period of time and within the limit of the available stock, according to the legislation in the field.
All prices presented on the Site are expressed in lei (RON) and include VAT. Under the conditions provided by law, the price of the Electronic Goods displayed on the Site, includes the Green Stamp Fee. If the Customer / Buyer requests details regarding the exact amount added to the price of the Goods, he will contact the Customer Relations Department D S.C. ELIXIR MANUFACTURA S.R.L. In the case of online payments the Seller is not / cannot be held responsible for any other additional costs incurred by the Buyer, including but not limited to currency conversion fees applied by the issuing bank of his card, if the currency of his issuance differs from RON.
ASSIGNMENT AND SUBCONTRACTING
The Seller may assign and / or subcontract a third party for Services related to the fulfillment of the Order, with the information of the Buyer, without the consent of the Buyer.
INTELLECTUAL AND INDUSTRIAL PROPERTY LAW
The content, as defined in the preamble, including but not limited to logos, stylized representations, commercial symbols, still images, dynamic images, text and / or multimedia content presented on the Site, are the exclusive property of S.C. ELIXIR MANUFACTURA S.R.L., to which all rights obtained in this regard are reserved directly or indirectly (through licenses for use and / or publication). Customer / Buyer is prohibited from copying, distributing, publishing, transferring to third parties, modifying and / or altering, using, linking to, exposing, including any Content in any context other than the original intended by S.C. ELIXIR MANUFACTURA S.R.L., the inclusion of any Content outside the Site, the removal of the signs that signify the copyright of S.C. ELIXIR MANUFACTURA S.R.L. on the Content, as well as participation in the transfer, sale, distribution of materials made by reproducing, modifying or displaying the Content. Any Content to which Customer / Buyer has and / or obtains access by any means, is subject to these terms and conditions, unless the Content is not accompanied by a specific and valid use agreement entered into between S.C. ELIXIR MANUFACTURA S.R.L. and customer / buyer / user.
Customer / Buyer may copy, transfer and / or use the Content only for personal or non-commercial purposes and only if it does not conflict with the provisions of these terms and conditions. If S.C. ELIXIR MANUFACTURA S.R.L. gives the Customer / Buyer the right to use in the form described in a separate use agreement, certain content, to which the Customer / Buyer has or obtains access as a result of this agreement, this right extends only to that or those contents defined in the agreement , only during the period of its existence or these contents on the site or the period defined in the agreement, according to the defined conditions.
No Content transmitted to the Customer or Buyer, by any means of communication (electronic, telephone, etc.) or acquired by him by accessing, visiting and / or viewing constitutes a contractual obligation of the company S.C. ELIXIR MANUFACTURA S.R.L., nor of the employee / agent S.C. ELIXIR MANUFACTURA S.R.L. which mediated the transfer of Content
Any use of the Content for purposes other than those expressly permitted by these terms and conditions or the accompanying use agreement, as the case may be, is prohibited.
ORDER AND WITHDRAWAL
The Customer / Buyer can place Orders on the Site, by adding the desired Goods and / or Services to the shopping cart, and will complete the Order by making the payment in one of the ways expressly indicated. Once added to the shopping cart, a Good and / or a Service is available for purchase to the extent that there is stock available for it. The addition of a Good / Service to the shopping cart, in the absence of completion of the Order, does not entail the registration of an order, implicitly also the automatic reservation of the Good / Service. By completing the Order, the Buyer declares that all data provided by him, necessary for the purchase process, are correct, complete and true at the date of placing the Order.
By completing the Order, the Buyer agrees that the Seller will contact him, by any means available / agreed by the Seller, in any situation where it is necessary to contact the Buyer. The Seller may cancel the Order placed by the Buyer, following a prior notification to the Buyer, without any subsequent obligation of either party to the other party or without any party being entitled to pay damages in the next case provided by the Customer / Buyer / user, on the Site are incomplete and / or incorrect.
The Buyer has the right to withdraw from the Contract, respectively to return a Good, within 14 calendar days, without having to justify the withdrawal decision and without being obliged to bear other costs. The seller will bear the cost of returning the products.
In accordance with the provisions of GEO no. 34/2004, the withdrawal period expires within 14 days from:
• the day on which the buyer / person indicated by him enters the physical possession of the products
• if the consumer orders through a single order multiple products that will be delivered separately, the day on which the buyer or the person indicated by the buyer enters into physical possession of the last product
• in the case of delivery of a product consisting of several lots or parts, the day on which the buyer or the person indicated by him enters into physical possession of the last product or the last part
• in the case of contracts with periodic delivery of products for a determined period of time, the day on which the buyer or the person indicated by him enters into physical possession of the first product.
The seller will be able to defer the refund until receipt of the Goods sold or until receipt of proof that the products have been shipped, if he has not offered to recover the Goods himself (the most recent date will be taken into account).
If a Good and / or Service ordered by the Buyer cannot be delivered by the Seller, the latter will inform the Customer / Buyer of this fact and will reimburse in the Buyer's account the value of the Good and / or the Service, within of maximum 7 (seven) days from the date on which the Seller became aware of this fact or from the date on which the Buyer expressly expressed its intention to terminate the Contract.
EXEMPTIONS FROM THE RIGHT OF WITHDRAWAL
The following are exempted from the right of withdrawal from the Contract: the supply of sealed products which cannot be returned for reasons of health protection or hygiene and which have been unsealed by the consumer;

SC ELIXIR MANUFACTURA S.R.L. will maintain the confidentiality of any information provided by the customer / user / buyer. Disclosure of the information provided may be made only under the conditions set out in this Document. No public statement, promotion, press release or any other means of disclosure to third parties will be made by the Buyer / Customer regarding the Order / Contract without the prior written consent of the Seller. By submitting information or materials through this site, the user / customer / buyer gives the Seller unrestricted access to them, the right to use, reproduce, display, modify, transmit and distribute such materials or information. By accepting the terms and conditions, the buyer / customer / user agrees that the Seller may freely use, in its own interest, this information, ideas, concepts, know-how or techniques that the buyer / customer / user has sent. through the Site. SC ELIXIR MANUFACTURA S.R.L. will not be subject to obligations regarding the confidentiality of the information sent, unless the legislation in force provides otherwise. By registering in the database of the company S.C. ELIXIR MANUFACTURA S.R.L., the Customer / Buyer expressly agrees, within the limits of the legislation in force, to be contacted by third parties, partners of S.C. ELIXIR MANUFACTURA S.R.L .: marketing service providers, other service providers in order to fulfill the object of the Contract concluded between the Buyer and the Seller, as well as by state, governmental agencies, when the legislation provides for this, as well as by other companies with which S.C. ELIXIR MANUFACTURA S.R.L. intends to develop joint bidding programs on the market for Goods and / or Services, etc.
BILLING - PAYMENT
The price, payment method and payment term are specified in each Order. The Seller will issue to the Buyer an invoice for the Goods and Services provided. The communication of all the information necessary for the issuance of the invoice according to the legislation in force is the responsibility of the Buyer.
The Seller will send to the Buyer the invoice related to the Order containing the Goods and / or Services sold by S.C ELIXIR MANUFACTURA S.R.L .. For the Goods and / or Services sold by the partners, as well as for any other payments related to the Order the partners concerned will issue separate invoices.
DELIVERY OF GOODS
The Seller undertakes to deliver the Goods by door-to-door courier system to the Buyer
The Seller will ensure the proper packaging of the Goods, as well as the transmission of the accompanying documents.
GUARANTEE
All Goods Marketed and / or Produced by S.C. ELIXIR MANUFACTURA S.R.L. they have unlimited deadlines.
TRANSFER OF PROPERTY OF GOOD
The ownership over the Goods will be transferred on the occasion of handing over the good, after making the payment, to the location indicated by the buyer by placing the order. Delivery is confirmed by signing the receipt of the transport document provided by the courier or signing the receipt on the fiscal invoice in case of deliveries made by the Seller's staff.
LIABILITY The Seller is not liable for damages of any kind that the Buyer or any third party may suffer as a result of the Seller's fulfillment of any of its obligations under the Order and for damages resulting from the use of the Goods and Services after delivery or for their loss. . PROCESSING OF PERSONAL DATA is carried out in accordance with the company's general policy on the processing of personal data. MAJOR FORCE Neither party will be liable for non-performance of its contractual obligations if such non-performance on time and / or properly, in whole or in part, is due to an event of force majeure. Force majeure is the unpredictable event, beyond the control of the parties and which cannot be avoided. If within 15 (fifteen) days from the date of its occurrence, that event does not cease, each party shall have the right to notify the other party of the full termination of the Contract without any of them being able to claim damages from the other. APPLICABLE LAW - JURISDICTION This Document / Contract is subject to Romanian law. Any disputes arising between S.C. ELIXIR MANUFACTURA S.R.L. and Customers / Buyers will be settled amicably or, if this is not possible, the disputes will be settled by the competent Romanian courts at the headquarters of the supplier S.C. ELIXIR MANUFACTURA S.R.L.
